NEET UG Leak Case: Delhi HC Orders NTA to Declare Results of 2 CBI Witnesses

The Delhi High Court has ordered the National Testing Agency to declare the NEET UG 2026 results of two candidates. Their scores were withheld after allegations of a leaked question paper. The court also allowed them to join further NEET UG counselling rounds for medical college admission. This is subject to meeting the prescribed eligibility criteria. Justice Jasmeet Singh passed the order on August 24 in the case of Aditya Vinod swami and another versus the National Testing Agency and others. Candidates Were CBI Witnesses Not Accused
The two candidates appeared for NEET UG on May 3, 2026. The examination was cancelled after allegations of a question paper leak. The candidates then appeared in the re-NEET examination. The CBI investigated the alleged leak and later filed a chargesheet. The two petitioners were listed as witnesses in that chargesheet. They were not accused in the case, despite this the NTA withheld their RE-NEET results. The agency issued show cause notices to them on July 5, 2026. The NTA told the court that the CBI had informed it that several candidates allegedly received or shared the question paper before the exam. The CBI submitted that the two candidates received the leaked paper and paid money to get it. Yet, the agency listed them as witnesses rather than accused.
Court Orders Result Declaration Within 24 Hours
The High Court noted the chargesheet allegations were yet to be tested in law. The allegations would have to be established through evidence. Withholding results on unproven allegations would cause serious prejudice to the candidates. The court said the candidates were at an early stage of their academic careers. Blocking them from counseling could create consequences that might not be fixed later. The court directed the NTA to declare the results within 24 hours of uploading the order. It also allowed the candidates to apply offline for counselling if their counselling results were not yet declared. The court clarified the order gives no immunity from future legal action. Authorities can still proceed against them if the allegations are later proved. The main petition is listed for hearing on January 8, 2027. The NTA has four weeks to file its response.
